The College has been working with adjunct faculty members and union representatives from the SEIU to negotiate a contract to set forth their terms and conditions of employment since October 2019. Mercy has met with the adjunct faculty and the union 19 times since discussions began and continues to negotiate in good faith to reach a timely agreement. However, this is typically a lengthy process. Not only is this process inherently difficult and time-consuming, but it has coincided with the COVID-19 global pandemic.
When a union wins a National Labor Relations Board (NLRB) election to represent a defined group of employees, it is granted the right to bargain with the employer. By law the employer can no longer deal directly with the employees regarding terms and conditions of employment; instead, it must deal exclusively with the union as the bargaining representative for the employees. Collective bargaining is the negotiating process by which wages, benefits, and other terms and conditions of employment are established in a unionized workplace
The bargaining process between colleges and unions is inherently difficult and time-consuming, especially when negotiations are over the first contract for a newly organized bargaining unit. Studies have shown that most first contracts take more than a year to negotiate, and sometimes they can take several years, particularly for large groups of employees with diverse backgrounds and work duties. One nearby example of this is the adjunct faculty contract at Pace University, which took more than four years to negotiate.
No, Mercy College is not anti-union. The College has bargained successfully for more than twenty years and has a cordial relationship with UAW 2110 representing our non-management staff.
No, Mercy is not responsible for dragging out the bargaining process. Unlike the SEIU Mercy College has never walked away from the bargaining table. Since negotiations began, Mercy has exchanged proposals on over 30 issues and topics, many of which have been memorialized in written and signed appropriate tentative agreements. In addition to these agreements, the College continues to seek compromises on important remaining issues through mutual exchanges of revised counterproposals. These actions show the College is committed to this process and reaching an initial contract. Contracts between colleges and unions as a norm tend to take time.
Through bargaining, the College has offered to establish and manage a dedicated professional development fund for adjuncts for stipends to participate in activities relating to their teaching such as course redesign and pedagogy-related projects. In addition, the College’s current Faculty Development grants program makes grant awards to faculty, whether full-time or part-time, to advance scholarship, research, and related pursuits (e.g., a project in the arts by a faculty member in an arts-related discipline).

Yes. Mercy remains committed to its mission of providing an exceptional education to students while still maintaining one of the lowest tuitions of any private college in the region. The College’s administration works diligently to manage expenses and meet the goal of maintaining compensation levels and general working conditions that are competitive with what our non-profit, private college peer institutions are providing. Student tuition is used for a wide variety of College services, activities, and resources. These not only include costs associated with offering each class, but also include expenses directly related to the classroom experience (including faculty salaries, classroom technology, and any course-specific supplies) as well as expenses related to supporting students’ academic experience (including tutoring, PACT, health and wellness services, and student life activities), and expenses related to operational costs of the College (including rent and maintenance).
Yes. Mercy’s goal is to maintain compensation levels and general working conditions that are competitive with what private college peer institutions are providing. However, it is important to note that Mercy is dedicated to ensuring that students have access to an affordable education and therefore carefully manages its expenditures to provide one of the lowest tuitions of any private college in the region. Some institutions of higher education in our area have tuition rates more than double those that Mercy students pay. Even with a lower tuition, Mercy is committed to providing students with similar resources and intends to be as competitive as possible to attract adjunct faculty who can deliver high quality educational experiences to our students.
